What Is Part 107.37 Operation Near Aircraft Waiver?

The Operation Near Aircraft Waiver allows an operator and team to safely operate near other moving aircraft.  

From FAA eCFR Website:

“§107.37   Operation Near Aircraft; Right-of-Way Rules.

(a) Each small unmanned aircraft must yield the right of way to all aircraft, airborne vehicles, and launch and reentry vehicles. Yielding the right of way means that the small unmanned aircraft must give way to the aircraft or vehicle and may not pass over, under, or ahead of it unless well clear.

(b) No person may operate a small unmanned aircraft so close to another aircraft as to create a collision hazard.”

Wow! What Does That Mean??

With the Operation Near Aircraft Waiver, remote pilots and visual observers may move closer toward other aircraft in the vicinity.  Each crew member must be briefed and ensure that the limitations are complied with to keep safety measures at a maximum.

How Many Have Been Approved?

At the time of writing this initially in early 2020, approximately 3,600 total Operational Waivers have been submitted and accepted by the FAA.  Most of these have been for a Part 107.29 Daylight Operation Waiver.  See the full list from the FAA Here.

What Needs To Be Addressed?

To increase your chances of being approved, you must include as many details as you can possibly think of. Include specific areas of operation, who or what are you flying over, any airspace within 5 miles, and any special considerations that are important to your operation.

  • Describe Proposed Operations
  • Explain Small UAS Details
  • Pilot and Personel Details
  • Explain Possible Risks
  • Explain How To Mitigate These Risks
